At SuperEnglish, we take the intellectual property rights of others seriously and expect our users to do the same.

In compliance with the Digital Millennium Copyright Act (DMCA) of 1998, if you own a copyright or are authorized to act on behalf of a copyright owner, and wish to report an infringement on SuperEnglish’s services, please send a notice that meets the DMCA requirements to [email protected]. We will take appropriate action accordingly.

DMCA Notice Requirements

Your notice must include:

  1. A description of the copyrighted work that you claim is being infringed.
  2. A description of the material you claim is infringing and that you want removed or access to which you want disabled, including the URL or other location of that material.
  3. Your name, title (if acting as an agent), address, telephone number, and email address.
  4. The following statement: “I have a good faith belief that the use of the copyrighted material I am complaining of is not authorized by the copyright owner, its agent, or the law (e.g., as a fair use).”
  5. The following statement: “The information in this notice is accurate and, under penalty of perjury, I am the owner, or authorized to act on behalf of the owner, of the copyright or of an exclusive right that is allegedly infringed.”
  6. An electronic or physical signature of the owner of the copyright or a person authorized to act on the owner’s behalf.

We will review your submission and take appropriate action under the DMCA, which may include removing the challenged content from our website. In appropriate circumstances, we may also disable access to or terminate the accounts of users who are reported.

DMCA Counter-Notice Requirements

If a resolution with the reporting copyright owner cannot be reached, the content owner may submit a DMCA Counter-Notice to [email protected]. Upon receiving a valid counter-notice, we will email a copy to the copyright owner. The Counter-Notice must comply with the DMCA and include:

  1. The URL(s) where the material that was the subject of the notification of claimed infringement appeared before it was removed or access to it was disabled.
  2. The name of the claimant who submitted the notification.
  3. Your SuperEnglish username (if you have one).
  4. Your full legal name.
  5. Your email address.
  6. Your full postal address (Street, Unit #, State, Postal Code, Country).
  7. Your phone number, including International Code.
  8. Verification statements, including your name and signature:
  • For UK-based individuals: “I consent to the jurisdiction of the courts of England and Wales for the judicial district in which my provided address is located.”
  • For individuals outside the UK: “I consent to the jurisdiction of any court in which SuperEnglish may be found.”

Trademark Takedown Request Requirements

If you wish to report content on SuperEnglish that you believe infringes your trademark, please provide:

  1. Details of the original trademark (and a description if it’s a logo).
  2. A list of the countries in which the trademark is registered.
  3. The registration number(s) of the trademark.
  4. A scanned copy of the trademark registration certificate(s) or a screenshot of the registration from the applicable national intellectual property office(s).
  5. A declaration with the following statement: “By submitting this notice, I state that I have a good-faith belief that the reported use, in the manner I have complained of, is not authorized by the intellectual property rights owner, its agent, or the law; that the information contained in this notice is accurate; and, under penalty of perjury, that I am authorized to act on behalf of the owner of the intellectual property rights at issue.”

Repeat Infringer Policy

We will suspend or terminate accounts if the user is determined to be a “repeat infringer.” In appropriate cases, and at our sole discretion, we may limit access to the SuperEnglish service and/or terminate accounts of users who blatantly infringe the intellectual property rights of others, whether or not repeat infringement has occurred. This may occur, for example, if a relevant court rules that the account holder is an infringer.
